• Desired treatment date and time

During the first treatment (medical history and patient declaration):

• Personal data: Date of birth, residential address, occupation
• Contact details: Telephone (private/business), mobile, e-mail
• Health insurance and supplementary insurance (yes/no)
• General practitioner and referrer
• Medications (including self-purchased products)
• Allergies and intolerances (especially to massage oils)
• Previous and current illnesses
• Surgeries (type and date)
• Medical treatments (last 12 months)
• Hospital stays (last 5 years)

Specific health information according to patient declaration:

• Cardiovascular diseases
• Respiratory diseases (asthma, hay fever)
• Digestive tract diseases
• Musculoskeletal diseases (spine, bones, muscles, ligaments, tendons)
• Urogenital tract diseases (kidneys, bladder, prostate, sexually transmitted diseases)
• High blood pressure
• Blood diseases
• Severe rheumatism
• Infectious diseases (hepatitis, tuberculosis, HIV/AIDS)
• HIV test (date and result)
• Implants (pacemaker, hip joint, etc.)

2.2 Legal basis for data processing

The processing of your personal data is based on the following legal grounds:

Contract fulfilment (Art. 6 para. 1 lit. b GDPR / Art. 13 DSG):
The collection of data is necessary for the provision of our services (massage treatment). The documentation serves professional treatment and the protection of your health.

Your consent (Art. 6 para. 1 lit. a GDPR / Art. 6 para. 6 DSG / Art. 9 para. 2 lit. a GDPR):
Particularly sensitive health data (as recorded in the patient declaration and in the SVBM report) will only becollected and processed with your explicit written consent.You provide this consent by signing the patient declaration.

Legal retention obligations (Art. 6 para. 1 lit. c GDPR / Art. 6 para. 5 DSG):
We are obliged to retain treatment documentation and patient records for tax, accounting, and medical purposes (Swiss Code of Obligations: 10 years).

2.3 Confidentiality and duty of confidentiality

All collected health data is subject to thetherapeutic duty of confidentiality.Your information will be treated as strictly confidential and will not be shared with third parties without your explicit consent.

Important:In your own interest, we ask you to report any health changes or the intake of new medications spontaneously, as this may affect your therapeutic treatment.

3. Purpose of data processing

Your data will be used exclusively for:

• Appointment management (arrangement, confirmation, reminder)
• Medical history and execution of the massage treatment
• Documentation of the treatment process
• Invoicing and payment processing
• Communication (inquiries, appointment changes)
• Fulfilment of legal retention obligations

4. Duration of storage

Patient records and treatment documentation:
Your health data, medical history, patient declaration, report documents (SVBM protocols) and treatment records will bekept for 10 yearsfrom the last treatment date. This corresponds to:

• Swiss Code of Obligations (OR Art. 962)
• Medical duty of care
• Therapeutic documentation obligations

After this period, all documents (physical and digital)will be destroyed or deleted in compliance with data protection regulations.

5. Disclosure of data

5.1 Principle

Your personal data will not be disclosed to third partiesunless:• You have expressly consented

General Terms and Conditions (GTC)

1. Scope of Application

These General Terms and Conditions apply to all services provided by Libra Schällebaum, Selina Schällebaum. This includes in particular: classical massage and other massage treatments according to the current offer.

By booking a treatment or entering the studio, you acknowledge these GTC as binding.

Deviating conditions of the customer will not be recognised unless Libra Schällebaum expressly agrees to their validity in writing.

2. Appointment Scheduling and Booking

Appointments can be arranged:

• Online via the booking system at www.libra-schaellebaum.ch

Binding nature:By scheduling an appointment (by phone, email or online), a binding contract is established between the customer and Libra Schällebaum.

Confirmation:For online bookings, you will receive an automatic confirmation email. Please check this for accuracy. If there are discrepancies, please contact us immediately.

Appointment Changes:Appointment changes are possible by arrangement. Please contact us as early as possible.

3. Cancellation and Annulment

3.1 Cancellation Period

Appointments can be cancelled free of charge up to24 hoursbefore the agreed appointment.The cancellation must be made: storniert werden.

3.2 Cancellation Fee for Late Cancellation

For cancellations less than 24 hours before the appointment or in case of no-show,100% of the agreed treatment pricewill be charged.

3.3 Exceptional Cases

In justified exceptional cases (e.g. acute illness, accident), the cancellation fee may be waived. This is at the discretion of Libra Schällebaum.

3.4 Delay

In the event of a delay by the client, the treatment time will be shortened accordingly. The full price will still be charged, as the subsequent appointment must be kept.

3.5 Cancellation by Libra Schällebaum

In cases of force majeure, illness, or other unforeseen events, Libra Schällebaum reserves the right to cancel appointments. You will be informed immediately and an alternative appointment will be offered. Claims for damages are excluded.

4. Prices and Payment Terms

4.1 Prices

The currently valid prices are available on the website www.libra-schaellebaum.ch or can be requested by phone. All prices are in Swiss Francs (CHF) and include VAT.

4.2 Payment Methods

Payment is made immediately after the treatment:

• Cash payment
• Card
• Invoice (upon request)

4.3 Invoicing

An invoice will be issued upon request. The invoice is due immediately and without deduction.

4.4 Billing through Health Insurance (Supplementary Insurance)

Libra Schällebaum is registered and recognised with the EMR (Experience Medicine Register) (ZSR No. W513464).

The services can usually be billed through thesupplementary insurancefor complementary medicine. Billing is done according to the principle of 'Tiers Garant':

1. The client pays the amount directly after the treatment (cash or card).

2. You will receive a reimbursement receipt that you can submit to your health insurance for reimbursement.

Important:Each health insurance has different reimbursement models. Please clarify before the first treatment whether and to what extent your supplementary insurance covers the costs. A denial of coverage by the insurance does not exempt you from the obligation to pay.

4.5 Vouchers

Vouchers are valid for 13 months from the date of issue. Cash redemption is not possible. No replacement will be provided in case of loss.

5. Treatment Procedure

5.1 Initial Treatment and Patient Declaration

During your first treatment, a detailed medical history conversation will be conducted, and you will be asked to fill out a patient declaration. This is for your safety and the professional execution of the treatment.

5.2 Health Status

Please inform us completely and truthfully about:

• All current and chronic illnesses
• Medication intake (including self-purchased products)
• Acute injuries or inflammations
• Pregnancy or breastfeeding
• Allergies (especially to massage oils or substances)
• Skin diseases
• Cardiovascular diseases
• Thrombosis or increased risk of thrombosis
• Recently performed surgeries
• Implants (pacemakers, artificial joints, etc.)
• Infectious diseases

5.3 Contraindications

Massage should not be performed in the case of certain conditions. In case of doubt, we reserve the right to refuse treatment or refer you to a doctor.

5.4 Substitute for Medical Treatment

Important:Massages do not replace conventional medicine but complement it. If you have health complaints, please consult a doctor. Remain under medical supervision.

5.5 Privacy

The treatment takes place in a discreet, calm atmosphere. You will be covered with towels during the massage. Only the areas of the body to be treated will be exposed.

6. Liability

6.1 Disclaimer of Liability

Libra Schällebaum is not liable for damages resulting from inadequate or incomplete information provided by the client regarding their health condition.

6.2 Side Effects

Massage is generally well tolerated. In rare cases, the following side effects may occur:

• Mild muscle soreness
• Temporary headaches
• Mild bruising (blue spots) on sensitive skin
• Allergic reactions to massage oils

If you experience any unusual discomfort after the treatment, please contact us immediately.

6.3 Precautions

After the treatment, you should:

• Get up slowly from the massage table (circulation)
• Drink plenty of water
• Avoid strenuous physical activities (first 2-3 hours)

6.4 Personal Items

No liability is accepted for valuables, cash, or personal items brought along. Please keep them safe.

6.5 Force Majeure

Libra Schällebaum is not liable for service disruptions due to force majeure or other unforeseeable events (e.g. natural disasters, pandemics, power outages).

7. Data Protection

Your personal data (name, address, phone, email, health information) will be collected and used solely for the provision of the service. Further information can be found in our Privacy Policy.

8. Photography and Marketing

Photos or videos of customers will only be used for marketing or advertising purposes with explicit written consent. Consent can be revoked at any time.

9. House Rules and Code of Conduct

9.1 Respectful Interaction

We expect all customers to interact respectfully and politely.

9.2 Alcohol and Drugs

Appearance under the influence of alcohol or drugs will result in the refusal of treatment. The treatment price will still be charged.

9.3 Inappropriate Behaviour

Inappropriate behaviour (verbal or physical harassment) will lead to immediate termination of treatment and a ban from the premises. The treatment price will be fully charged. Legal action remains reserved.

10. Changes to the Terms and Conditions

Libra Schällebaum reserves the right to change these terms and conditions at any time. The current version is available on the website www.libra-schaellebaum.ch . Existing customer relationships will be informed of changes via email.

11. Applicable Law and Jurisdiction

Applicable Law:Swiss law exclusively applies to all legal relationships between Libra Schällebaum and the customer.
Jurisdiction:The exclusive jurisdiction for all disputes is Basel-Stadt, Switzerland.
Language:The German version of these terms and conditions is authoritative.

12. Severability Clause

Should individual provisions of these terms and conditions be or become ineffective or unenforceable, the validity of the remaining provisions shall remain unaffected. The ineffective provision shall be replaced by a valid one that comes closest to the economic purpose of the ineffective provision.
